Welcome to mimo sewing club. The terms "we", "us", and "our" refer to mimo sewing club, registered with the Dutch Chamber of Commerce (Kamer van Koophandel) under number 88725731, VAT number NL004641223B79, with its registered place of business at Vijverhofstraat 47, Unit 304, 3032SB Rotterdam, the Netherlands.

mimo sewing club operates this website and online store, including all related information, content, features, tools, products, and services (the "Services"). mimo sewing club is powered by Shopify, which enables us to provide the Services to you.

The following terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities in connection with the use of the Services. Please read these Terms carefully, as they contain important information regarding your legal rights, including applicable disclaimers and limitations of liability.

These Terms of Service, together with our Privacy Policy, constitute the agreement between mimo sewing club and the customer with respect to any order placed through our Services. By placing an order, the customer accepts these Terms in full. These Terms are governed by Dutch law and, where applicable, by European Union consumer protection legislation.

SECTION 1 - ACCESS AND ACCOUNT

By placing an order through our Services, you represent that you are at least 18 years of age, or the age of majority in your country of residence if higher. The Services are intended exclusively for adults. Persons under the age of 18 are not permitted to use or access the Services.

To use the Services, including purchasing any of the products or services we offer, you may be required to provide certain information, including your email address, billing, payment, and shipping information. You represent and warrant that all information provided is accurate, current, and complete, and that you hold all rights necessary to provide such information.

You are solely responsible for maintaining the security of your account credentials and for all activity conducted under your account. Account credentials may not be transferred, sold, assigned, or licensed to any third party.

SECTION 2 - OUR PRODUCTS

mimo sewing club makes every effort to represent its products and services accurately on this website. Please note that the appearance of colours and materials may vary depending on your device, screen settings, and display configuration. Such variations do not constitute a defect or non-conformity of the product.

Products and services offered through our Services are subject to the statutory conformity requirements of Dutch law (Article 7:17 of the Dutch Civil Code). The above disclaimer applies exclusively to subjective aesthetic expectations and does not affect your statutory rights with respect to product conformity.

All product descriptions, specifications, and availability are subject to change at any time without prior notice, at our sole discretion. mimo sewing club reserves the right to discontinue any product at any time and to limit the quantities of any products offered to any person, geographic region, or jurisdiction on a case-by-case basis.

SECTION 2.1 - SEWING PATTERNS AND BUNDLES TERMS AND CONDITIONS

By purchasing any sewing pattern or bundle from this store, whether individually or as part of a bundle, you enter into a binding agreement and accept the following terms.

Language

All sewing patterns and instructions are provided in English.

Usage Rights

Purchased patterns may be used for personal projects or to create finished physical products for sale. It is strictly prohibited to copy, share, sell, or distribute pattern files in any form, whether modified or unmodified. All intellectual property rights in the patterns remain with their respective rights holders.

Contents

The contents of each sewing pattern, including instructions, files, and supporting materials, may be updated, revised, or amended at any time without prior notice. For bundle purchases, the contents of a bundle, including any patterns, materials, or supplementary items, are subject to change at any time without prior notice. Premium or exclusive patterns are not guaranteed to be included in bundles. Additional patterns or periodic releases are not guaranteed and may be modified or discontinued.

Digital Delivery and Withdrawal

Patterns are delivered as digital downloads. By completing your purchase, you acknowledge that the product will be made available for immediate download and that, once delivery has commenced, the purchase is final and no refund, withdrawal, or cancellation can be processed. For customers in the European Union, this acknowledgement constitutes your consent to immediate delivery and your acceptance of the loss of the statutory right of withdrawal under applicable EU consumer law, including Article 6:230p(c) of the Dutch Civil Code. All sales of digital content are final regardless of your country of residence.

Download Access and Fair Use

Download activity is monitored to prevent abuse. In the event that our systems detect unusual or excessive download activity on your account, we reserve the right to temporarily limit or suspend your download access pending review. In cases of confirmed abuse, including but not limited to systematic or commercial-scale distribution of pattern files, download access may be permanently revoked without refund. Any such determination will be subject to human review prior to permanent action being taken. Where access is suspended pending review, we will contact you at the email address registered to your account.

Acknowledgement

By completing your purchase, you confirm that you have read and agree to these terms in full, as well as our general Refund Policy.

SECTION 2.2 – IN-PERSON WORKSHOP TERMS AND CONDITIONS

These terms apply to all in-person workshops organised by mimo sewing club (“we”, “us”) and supplement the general Terms of Service. By purchasing a ticket, the participant (“you”) agrees to these terms in full.

Language

All workshops are conducted in English. By registering, you confirm you have sufficient English proficiency to follow instructions and demonstrations.

Nature of the Workshop

Workshops are project-based creative sessions for making one specific item. They do not constitute a sewing class, course, or educational programme. Instruction is limited to the skills required for that session’s project only.

Materials

mimo sewing club retains sole discretion over the selection of fabrics, colours, and materials. Participants cannot select or substitute specific materials or components. Provision of materials is subject to availability and may vary without notice.

Inherent Risks and Liability

Workshops involve tools and equipment with inherent risks including sewing machines, needles, scissors, rotary cutters, irons, and steam equipment. By attending, you acknowledge these risks and accept that participation is at your own risk.

To the extent permitted by Dutch law, mimo sewing club accepts no liability for personal injury, loss, or damage arising from workshop participation. This exclusion does not apply in cases of gross negligence (bewuste roekeloosheid) or intentional misconduct (opzet) on our part, pursuant to Book 6 of the Burgerlijk Wetboek. You are required to follow all safety instructions given during the session.

Equipment

All equipment remains the property of mimo sewing club. You agree to use it in accordance with instructions provided. In the event of damage caused by misuse, reckless handling, or use contrary to instructions, you may be held liable for the reasonable cost of repair or replacement pursuant to Article 6:162 BW. No liability applies for damage from normal, instruction-compliant use.

Food, Drinks, and Allergies

Complimentary food and drinks may be provided. You must disclose any food allergies, intolerances, or dietary requirements by email to hello@mimosewing.club at least 24 hours before the workshop. Where no timely notification has been received, mimo sewing club accepts no liability for any adverse reaction or injury arising from consumption of food or drinks during the session.

Workshop Content

Any complimentary items (including patterns, materials, or refreshments) and workshop content, structure, or agenda may be changed at any time without notice and do not constitute a guaranteed component of the ticket. Such changes do not give rise to a right of (partial) refund.

Cancellation

Workshops require a minimum number of participants. If the threshold is not met, the workshop may be cancelled and you will receive a full refund.

We also reserve the right to cancel at any time, including at short notice or on the day, due to circumstances we could not reasonably have anticipated or controlled – including sudden illness, personal emergency, venue issues, or force majeure. In such cases you will receive a full refund, processed within 14 days of the cancellation notification. We are not liable for any consequential costs such as travel or accommodation.

Participant Cancellation and No-Refund Policy

Pursuant to Article 6:230p(e) of the Dutch Civil Code, the statutory right of withdrawal does not apply to dated leisure event tickets. All ticket sales are final; no refund, credit, or exchange will be issued for participant cancellations. Tickets may be transferred to another person provided mimo sewing club is notified in writing at hello@mimosewing.club no later than 24 hours before commencement.

Photography and Video

Photographs and video recordings may be taken during workshops and used for marketing and promotional purposes (including on social media and our website). We process this material on the basis of legitimate interest pursuant to Article 6(1)(f) AVG/GDPR, given the ticketed and public-facing nature of our events.

If you do not wish to be photographed or filmed, notify us in writing at hello@mimosewing.club at least 24 hours before the workshop. Requests received less than 24 hours prior to commencement cannot be guaranteed to be accommodated.

Under the AVG/GDPR you have the right to object to processing of your image (Article 21 GDPR) and to request erasure of identifiable recordings we hold (Article 17 GDPR), where no overriding legitimate grounds exist. Submit requests to hello@mimosewing.club; we will respond within one month (Article 12 GDPR). Note that material already published or shared with third parties prior to your request may not be retrievable.

Communications

We fulfil notification obligations by emailing the address provided at registration. We accept no liability for non-receipt caused by spam filters, email provider issues, or other factors outside our control. The participant bears responsibility for ensuring that emails from hello@mimosewing.club are not blocked or filtered and for monitoring the registered email address for correspondence relating to their booking. Where time permits, we may additionally attempt to communicate via our social media channels; no obligation to do so arises under these terms.

Governing Law

These Workshop Terms are governed exclusively by Dutch law. Any disputes shall be submitted to the competent court in Rotterdam, the Netherlands. In the event of conflict between these Workshop Terms and the general Terms of Service, these Workshop Terms prevail for matters relating to in-person workshop participation.

SECTION 2.3 - FABRICS AND NOTIONS TERMS AND CONDITIONS

By purchasing fabrics or notions (sewing supplies) from mimo sewing club, whether through our online store, physical location, or any other sales channel, you agree to the following terms.

Statutory Conformity Guarantee

All physical goods sold by mimo sewing club are subject to your statutory rights under Dutch law and the Richtlijn consumentenkoop (EU Directive 2019/771), including the statutory two-year conformity guarantee. Nothing in these terms affects those statutory rights.

Fabric Colour and Dye Lots

Whilst every effort is made to represent fabric colours accurately on our website and in our physical store, colour appearance may vary depending on your screen settings, device configuration, and ambient lighting conditions. Such variation does not constitute a defect or non-conformity.

Fabrics are produced in dye lots, and colour consistency between separate production runs cannot be guaranteed. Where colour consistency across a larger quantity is essential, you are advised to purchase the required amount in a single order. mimo sewing club accepts no liability for colour variation between fabric purchased in separate orders or at different times.

Cut Fabric and Withdrawal Rights

All fabric sold by mimo sewing club is cut to order and is therefore made to your specifications. Pursuant to Article 6:230p(f) of the Dutch Civil Code, the statutory right of withdrawal does not apply to goods that are clearly personalised or made to the consumer's specifications. Accordingly, all fabric sales are final once cut and no refund, return, or exchange will be issued on the grounds of a change of mind. This exclusion does not affect your statutory conformity rights.

Notions and Sewing Supplies

Notions and sewing supplies sold in sealed or hygienic packaging may not be returned once the packaging has been opened, pursuant to Article 6:230p(g) of the Dutch Civil Code. Unopened notions may be returned within the statutory withdrawal period of 14 days from the date of receipt, in accordance with our Refund Policy, provided they are returned in their original condition and packaging at the customer's expense.

Product Availability

All fabrics and notions are subject to availability. mimo sewing club reserves the right to discontinue any fabric or notion at any time without prior notice. In the event that an ordered product is no longer available after an order has been placed, you will be notified promptly and offered the choice of an alternative product or a full refund.

Acknowledgement

By purchasing fabrics or notions from mimo sewing club, you confirm that you have read and agree to these terms in full, as well as our general Refund Policy.

SECTION 3 - ORDERS

A binding agreement between you and mimo sewing club is formed upon completion of payment and receipt of an order confirmation. mimo sewing club reserves the right to cancel any order after acceptance for any legitimate reason, including pricing errors, product unavailability, or concerns regarding order validity. In such cases, a full refund will be issued promptly and you will be notified via the email address provided at the time of the order. Any payment received in respect of a cancelled order will be refunded in accordance with our Refund Policy.

Your right to cancel or return an order is governed by our Refund Policy and, where applicable, by your statutory rights under Dutch law and European Union consumer protection legislation. Nothing in these Terms limits or excludes any statutory rights you may have as a consumer.

These Terms are governed by Dutch law. Customers outside the European Union acknowledge that they are purchasing on that basis. Nothing in these Terms excludes any mandatory consumer rights applicable under the laws of the customer's country of residence that cannot be waived by contract.

SECTION 4 - PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email.

Prices displayed on our website include VAT where required by applicable law for customers within the European Union. For customers outside the European Union, prices are displayed excluding local taxes, duties, customs, or import charges, which remain the sole responsibility of the customer. Unless otherwise expressly stated, posted prices do not include shipping or handling charges.

Prices posted on our website may differ from prices offered at our physical location. Prices offered through third-party platforms or marketplaces where mimo sewing club's products may be listed are set independently and may differ from prices on our website or at our physical location. mimo sewing club is under no obligation to match prices across different sales channels.

We may offer promotions from time to time that affect pricing and that are governed by terms and conditions separate from these Terms. In the event of a conflict between the terms of a promotion and these Terms, the promotion terms shall prevail.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases. You represent and warrant that (i) the payment information you provide is true, correct, and complete, (ii) you are duly authorised to use the selected payment method for the purchase, (iii) charges incurred by you will be honoured by your payment provider, and (iv) you will pay all charges incurred at the posted prices, including any applicable shipping, handling, and taxes.

SECTION 5 - SHIPPING AND DELIVERY

mimo sewing club aims to dispatch physical orders within the timeframe stated on the relevant product page or, where no timeframe is stated, within 30 days of order confirmation, in accordance with Article 7:10 of the Dutch Civil Code. In the event that dispatch is not possible within this period, you will be notified promptly and offered the option to agree to a revised delivery timeframe or to cancel your order and receive a full refund.

Delivery times communicated at the time of purchase are estimates only and are not guaranteed. mimo sewing club accepts no liability for delays caused by shipping carriers, customs processing, or other circumstances outside our reasonable control. Where a delay is attributable to circumstances outside our control, we will notify you as soon as reasonably practicable and take reasonable steps to minimise the impact of the delay.

Risk of loss and damage to physical products during transit remains with mimo sewing club until the goods are received by you or a third party nominated by you to receive the delivery, in accordance with Article 7:11 of the Dutch Civil Code. Once delivery has been confirmed, risk passes to you.

mimo sewing club is not responsible for delays or failed deliveries resulting from inaccurate or incomplete shipping information provided by the customer. The customer bears responsibility for ensuring that the shipping address provided at the time of order is accurate and complete.

For fabric orders, please note that fabrics are cut to order and are prepared for dispatch following confirmation of payment. Where an order includes fabric cut from multiple rolls, items may be dispatched separately. mimo sewing club takes reasonable care in the packaging of fabric and notions to ensure they arrive in good condition. In the event that goods arrive damaged in transit, please notify us at hello@mimosewing.club within 48 hours of receipt, providing photographic evidence where possible, so that we may assess the damage and arrange repair, replacement, or refund in accordance with your statutory rights.

Digital products are not subject to physical shipping. Delivery of digital products is deemed complete upon the product being made available for download, in accordance with the terms set out in Section 2.

SECTION 6 - INTELLECTUAL PROPERTY

All content and materials available through our Services, including but not limited to trademarks, trade names, text, images, graphics, product descriptions, reviews, video, and audio, and the design, selection, and arrangement thereof, are the property of mimo sewing club, its affiliates, or its licensors, and are protected under Dutch and European Union intellectual property law, including but not limited to the Auteurswet (Dutch Copyright Act), the Benelux Convention on Intellectual Property, and applicable EU directives and regulations.

Except as expressly set out in these Terms, including the usage rights granted to customers in Section 2 with respect to purchased sewing patterns, all content and materials available through our Services are provided for your personal, non-commercial use only. Nothing in these Terms grants you any right to reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from our Services without the prior written consent of mimo sewing club. Unauthorised use of our content or materials may constitute an infringement of intellectual property rights under applicable Dutch and EU law.

The trade name, logo, product and service names, designs, and slogans of mimo sewing club are protected trademarks and trade names. You may not use any of these without the prior written permission of mimo sewing club. The name, logo, and associated marks of Shopify are the trademarks of Shopify Inc. All other names, logos, product and service names, designs, and slogans appearing on our Services are the property of their respective owners.

SECTION 7 - OPTIONAL TOOLS

mimo sewing club may provide access to tools and features offered by third-party providers as part of the Services. Such tools are provided for your convenience only. mimo sewing club does not monitor, control, or endorse third-party tools and accepts no responsibility for their content, functionality, availability, or accuracy.

Access to third-party tools is provided on an "as is" and "as available" basis, without warranties, representations, or conditions of any kind. To the extent permitted by applicable Dutch law, mimo sewing club accepts no liability arising from or relating to your use of optional third-party tools. This limitation does not apply in cases of gross negligence (bewuste roekeloosheid) or intentional misconduct (opzet) on the part of mimo sewing club, pursuant to Book 6 of the Burgerlijk Wetboek.

Your use of any third-party tools made available through our Services is entirely at your own risk. You are responsible for familiarising yourself with and agreeing to the terms and conditions of any relevant third-party provider before making use of their tools. mimo sewing club reserves the right to act on reports of illegal content or activity involving third-party tools accessible through our Services, in accordance with applicable Dutch law and the Digital Services Act (DSA).

mimo sewing club may introduce new features, tools, or resources through the Services at any time. Such additions shall be deemed part of the Services and shall be subject to these Terms of Service upon their introduction.

SECTION 8 - THIRD-PARTY LINKS

Our Services may contain hyperlinks to and materials from websites operated by third parties, including embedded third-party functionality. mimo sewing club is not responsible for examining or evaluating the content, accuracy, availability, or practices of any third-party websites or materials.

Access to third-party websites via links on our Services is entirely at your own risk. To the extent permitted by applicable Dutch law, mimo sewing club accepts no liability for any harm, loss, or damage arising from your access to or use of any third-party website, or from your purchase or use of any products, services, resources, or content obtained through third-party websites. This limitation does not apply in cases of gross negligence (bewuste roekeloosheid) or intentional misconduct (opzet) on the part of mimo sewing club, pursuant to Book 6 of the Burgerlijk Wetboek.

Prior to engaging in any transaction through a third-party website, you are advised to review the relevant third party's terms, conditions, and privacy practices. All complaints, claims, or questions regarding third-party products and services should be directed to the relevant third-party provider.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

mimo sewing club operates its online store through Shopify, an e-commerce platform provided by Shopify Inc. All sales and purchases made through our Services are transactions directly between you and mimo sewing club. Shopify acts solely as the platform provider and is not a party to any transaction between you and mimo sewing club.

All contractual rights and obligations arising from orders placed through our Services exist exclusively between you and mimo sewing club. Any complaints, claims, or questions relating to your purchase should be directed to mimo sewing club in the first instance, using the contact details set out in Section 24 of these Terms.

Shopify's own terms of service and privacy policy govern the relationship between you and Shopify with respect to your use of the Shopify platform. mimo sewing club encourages you to review Shopify's policies, available at shopify.com, for information on how Shopify processes your data and manages its platform.

SECTION 10 - PRIVACY POLICY

The collection and processing of personal data by mimo sewing club is governed by our Privacy Policy, which forms part of these Terms of Service and is incorporated herein by reference. Our Privacy Policy is available at all times on our website and sets out in detail how we collect, use, store, and share your personal data, in accordance with the General Data Protection Regulation (AVG/GDPR) and other applicable Dutch and EU data protection legislation.

By placing an order through our Services, you will be provided with the information required under Articles 13 and 14 of the AVG/GDPR regarding the processing of your personal data. You are encouraged to review our Privacy Policy prior to placing an order.

As our Services are hosted by Shopify, certain personal data may be processed by Shopify Inc. and its affiliates in connection with the provision of the platform. Shopify may transfer and process data in countries outside the European Union. Full details of how Shopify processes personal data are set out in Shopify's Privacy Policy, available at shopify.com. mimo sewing club encourages you to review Shopify's Privacy Policy for further information.

SECTION 11 - FEEDBACK

If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, or other content (collectively, "Feedback"), you grant mimo sewing club a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any purpose, including for commercial use. Where Feedback contains personal data, such data remains subject to our Privacy Policy and your rights under the AVG/GDPR, notwithstanding the licence granted herein.

You represent and warrant that (i) you own or hold all rights necessary to submit the Feedback; (ii) you have disclosed any compensation, incentives, or benefits received in connection with the submission of Feedback, in accordance with applicable rules on endorsements and commercial communications under Dutch and EU law; and (iii) your Feedback complies with these Terms of Service. mimo sewing club is under no obligation to maintain Feedback in confidence, to pay compensation for Feedback, or to respond to Feedback.

You are solely responsible for the accuracy and content of any Feedback you submit. You may not use a false identity, false email address, or otherwise misrepresent the origin of your Feedback. mimo sewing club accepts no liability for Feedback submitted by third parties, except in cases of gross negligence (bewuste roekeloosheid) or intentional misconduct (opzet) on our part, pursuant to Book 6 of the Burgerlijk Wetboek.

mimo sewing club reserves the right to monitor, edit, or remove Feedback that it determines to be unlawful, offensive, defamatory, infringing of third-party rights, or otherwise in violation of these Terms. In addition, mimo sewing club is required to act on reports of illegal content in accordance with its obligations under the Digital Services Act (DSA) and applicable Dutch law. The existence of this right does not impose an obligation on mimo sewing club to actively monitor all Feedback at all times.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

Whilst every effort is made to ensure the accuracy of information published through our Services, errors, inaccuracies, or omissions may occasionally occur in relation to product descriptions, pricing, promotions, shipping charges, transit times, or availability. mimo sewing club reserves the right to correct any such errors, inaccuracies, or omissions and to update information on our Services at any time without prior notice.

In the event that an error or inaccuracy affects an order that has already been placed, mimo sewing club reserves the right to cancel that order in accordance with Section 3 of these Terms. In such cases, you will be notified via the email address provided at the time of the order and any payment received will be refunded in full in accordance with our Refund Policy.

SECTION 13 - PROHIBITED USES

You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly:

(a) for any unlawful or malicious purpose, or in violation of any applicable Dutch, European Union, or international law or regulation; (b) to infringe upon or violate the intellectual property rights of mimo sewing club or any third party; (c) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate against any person; (d) to transmit false, misleading, or deceptive information; (e) to send unsolicited commercial communications, including spam, chain letters, or similar content; (f) to impersonate any person or entity or otherwise misrepresent your identity or affiliation; (g) to upload or transmit viruses, malware, or any other malicious code that may affect the functionality or security of our Services or related systems; (h) to collect, harvest, or process the personal data of other users without a lawful basis under the AVG/GDPR; (i) to reproduce, duplicate, copy, sell, or exploit any portion of the Services without our prior written consent; or (j) to interfere with or circumvent the security features of the Services or any related systems or networks.

In the event of a suspected violation of these prohibitions, mimo sewing club reserves the right to suspend or terminate your access to the Services. Where access is suspended or terminated, you will be notified via the email address registered to your account and provided with a brief statement of the reasons, in accordance with applicable Dutch law and the Digital Services Act (DSA). Nothing in this section affects your right to contest such a decision by contacting us at hello@mimosewing.club.

SECTION 14 - TERMINATION

mimo sewing club reserves the right to suspend or terminate your access to the Services, or any part thereof, for any legitimate reason, including but not limited to a breach of these Terms of Service, non-payment, or conduct that mimo sewing club reasonably considers harmful to the Services, other users, or third parties. Where access is suspended or terminated, you will be notified via the email address registered to your account and provided with a brief statement of the reasons, in accordance with DSA art. 17. You remain liable for all amounts due up to and including the date of termination.

The following provisions shall survive termination of these Terms and continue to apply thereafter: Intellectual Property (Section 6), Feedback (Section 11), Disclaimer of Warranties (Section 15), Limitation of Liability (Section 16), Indemnification (Section 17), Severability (Section 18), Governing Law (Section 21), Privacy Policy (Section 10), and any other provisions that by their nature should survive termination.

SECTION 15 - DISCLAIMER OF WARRANTIES

The information published through our Services is made available for general information purposes only. mimo sewing club does not warrant the accuracy, completeness, or suitability of such information for any particular purpose. Any reliance you place on information available through our Services is at your own risk.

Customers outside the European Union acknowledge that the above disclaimer is governed by Dutch law. Nothing in this section excludes any mandatory warranty rights applicable under the laws of the customer's country of residence that cannot be waived by contract.

SECTION 16 - LIMITATION OF LIABILITY

To the fullest extent permitted by applicable Dutch and European Union law, mimo sewing club, its owner, employees, affiliates, agents, contractors, service providers, and licensors shall not be liable for any indirect, incidental, special, or consequential loss or damage of any kind, including but not limited to loss of profits, loss of revenue, loss of data, or replacement costs, arising from your use of the Services or any products purchased through the Services, whether based in contract, tort, or otherwise.

This limitation of liability does not apply in cases of gross negligence (bewuste roekeloosheid) or intentional misconduct (opzet) on the part of mimo sewing club, pursuant to Book 6 of the Burgerlijk Wetboek, nor does it apply to any liability that cannot be excluded or limited under mandatory Dutch or European Union law.

Nothing in this section affects your statutory rights as a consumer. Where Dutch or European Union law imposes a mandatory minimum level of liability that cannot be excluded by contract, mimo sewing club's liability shall be limited to that minimum extent.

Customers outside the European Union acknowledge that this limitation of liability is governed by Dutch law. Nothing in this section excludes any mandatory rights or remedies applicable under the laws of the customer's country of residence that cannot be waived by contract.

SECTION 17 - INDEMNIFICATION

You agree to indemnify and hold harmless mimo sewing club, its owner, employees, affiliates, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims arising from (1) your breach of these Terms of Service, (2) your violation of any applicable law or the rights of a third party, or (3) your submission of Feedback or other content through our Services that infringes the rights of any third party.

Where a claim arises to which this indemnification applies, mimo sewing club will notify you promptly and you agree to cooperate reasonably in the handling of such claim. Any recoverable costs shall be determined in accordance with Article 6:96 of the Dutch Civil Code.

Nothing in this section requires you to indemnify mimo sewing club for any claim arising from our own gross negligence (bewuste roekeloosheid) or intentional misconduct (opzet), or from any breach of these Terms by mimo sewing club.

SECTION 18 - SEVERABILITY

If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable under applicable Dutch or European Union law, that provision shall be deemed severed from these Terms to the minimum extent necessary, and the remaining provisions shall continue in full force and effect. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision of these Terms.

SECTION 19 - WAIVER; ENTIRE AGREEMENT

The failure of mimo sewing club to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. Any waiver of a specific right or provision shall not be deemed a waiver of any other right or provision.

These Terms of Service, together with our Privacy Policy, Refund Policy, and any other policies incorporated herein by reference, constitute the agreement between mimo sewing club and the customer with respect to orders placed through our Services. These Terms supersede any prior agreements, communications, or proposals between the parties, whether oral or written, relating to the same subject matter. Nothing in this section affects the legal relevance of pre-contractual information provided by mimo sewing club prior to the conclusion of an agreement, including product descriptions, pricing information, and any representations made in connection with a specific order, which remain subject to applicable Dutch and European Union consumer law.

In the event of any ambiguity in the interpretation of these Terms, such ambiguity shall be resolved in accordance with Article 6:238 lid 2 of the Dutch Civil Code, which provides that in consumer contracts, ambiguous terms shall be interpreted in the manner most favourable to the consumer.

SECTION 20 - ASSIGNMENT

You may not delegate, transfer, or assign these Terms or any of your rights or obligations hereunder without the prior written consent of mimo sewing club. Any purported assignment without such consent shall be null and void.

mimo sewing club reserves the right to transfer, assign, or delegate these Terms and its rights and obligations hereunder, including in the context of a merger, acquisition, or sale of assets, provided that you are notified of any such assignment via the email address registered to your account within a reasonable period. Where an assignment materially affects your rights or the nature of the Services provided to you, you retain the right to terminate your account and, where applicable, receive a refund for any unfulfilled orders in accordance with our Refund Policy.

SECTION 21 - GOVERNING LAW AND JURISDICTION

These Terms of Service, and any agreements or obligations arising therefrom, shall be governed by and construed exclusively in accordance with the laws of the Netherlands. Any disputes arising out of or in connection with these Terms, or any order placed through our Services, shall be submitted to the exclusive jurisdiction of the competent court in Rotterdam, the Netherlands (Rechtbank Rotterdam).

Notwithstanding the foregoing, customers within the European Union retain the right to invoke any mandatory consumer protections applicable under the laws of their country of residence that cannot be waived by contract. Customers outside the European Union acknowledge that their relationship with mimo sewing club is governed by Dutch law, without prejudice to any mandatory consumer rights applicable under the laws of their country of residence that cannot be waived by contract.

Customers within the European Union may also make use of the European Commission's Online Dispute Resolution platform, available at ec.europa.eu/consumers/odr, as an alternative means of resolving disputes arising from online purchases.

mimo sewing club is committed to addressing customer complaints promptly and fairly. If you have a complaint relating to any aspect of our Services, products, or these Terms of Service, please contact us in the first instance by email at hello@mimosewing.club, providing a clear description of your complaint and any relevant order details.

mimo sewing club will acknowledge receipt of your complaint within 5 business days and endeavour to provide a substantive response within 14 days of receipt. Where a complaint requires additional time to investigate, you will be informed of the expected timeframe for resolution.

If your complaint cannot be resolved directly with mimo sewing club, customers within the European Union may escalate their complaint to the Autoriteit Consument en Markt (ACM) at acm.nl, or make use of the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Customers in the Netherlands may also contact the Geschillencommissie where applicable.

SECTION 25 - FORCE MAJEURE

mimo sewing club shall not be liable for any failure or delay in the performance of its obligations under these Terms where such failure or delay arises from circumstances beyond its reasonable control (overmacht) within the meaning of Article 6:75 of the Dutch Civil Code, including but not limited to natural disasters, pandemics, strikes, civil unrest, government actions, failure of third-party infrastructure or services, power outages, or interruptions to internet or telecommunications services (each a "Force Majeure Event").

In the event of a Force Majeure Event, mimo sewing club will notify affected customers as promptly as reasonably practicable and will take reasonable steps to minimise the impact of the event on the Services. Where a Force Majeure Event prevents mimo sewing club from fulfilling an order within a reasonable period, customers shall be entitled to cancel their order and receive a full refund in accordance with our Refund Policy.

This section does not affect your statutory rights as a consumer under applicable Dutch or European Union law.

SECTION 26 - CHANGES TO TERMS OF SERVICE
